General Terms and Conditions Hemafit GmbH (AGB)

 

1.   General information

The following General Terms and Conditions of Sale and Delivery apply to our deliveries, unless otherwise agreed in writing between the Buyer and Hemafit. If individual points are not regulated below, the Swiss Code of Obligations shall apply on a subsidiary basis. The GTC form an integral part of the respective order.

2.   Object

Hemafit produces and sells orthopaedic foot supports.

3.   Order / Order acceptance / Returns

Buyers order the item in the webshop (online). The buyer's order is binding. Cancellations or returns are only possible with the written consent of Hemafit. Any costs incurred in the event of revocation or modification shall be borne by the buyer.

4.   Prices / scope of services

The item prices are fixed in the online store. Deliveries are made in accordance with the general terms and conditions as stated on the order form.

5.   General terms and conditions of purchase and payment

Detailed information can be found on the order forms or the invoices issued. All prices include the statutory value added tax.

6.   Delivery / Dispatch / Delay in delivery

Deliveries are made ex works, Rotkreuz (Switzerland). Shipping is therefore at the expense and risk of the buyer. Deliveries are made within 3 - 6 working days, whereby Hemafit cannot be held liable for delays caused by force majeure.

7.   Checking the goods / acceptance / complaints

Upon receipt of the goods, the Buyer is obliged to notify Hemafit in writing of any defects found immediately, but at the latest within 8 days. If no written report is made within this period, the delivery is deemed to have been received in good order and free of defects.

8.   Warranty

The footbeds supplied are carefully produced and meet the highest material standards. Hemafit grants a 2-year guarantee on all products from the date of purchase on presentation of the invoice/receipt. Product damage or defects that occur during this period despite proper use and care will be repaired free of charge. Changes to the product or the packaging do not constitute a defect. Improper use or handling of the goods invalidates the warranty or the right to claim for defects.

9.   Data protection

We use the data provided by you to fulfill and process your order. No personal data will be passed on to third parties without the customer's knowledge. Exceptions to this are data that must be transmitted for the execution of orders, for the processing and control of payments and for statistical analysis.

10.   Place of fulfillment and jurisdiction

The place of performance for the delivery of the purchased items is Hemafit's registered office in Rotkreuz, Switzerland. Material and price risk shall pass to the Buyer upon dispatch or collection by the post office.

Swiss law shall apply exclusively. For all disputes the ordinary court in Zug, Switzerlandresponsible.
